These Terms & Conditions (the “Terms”) govern the sale of products by GetGoArt (referred to as “we,” “us,” or “our”) through our website, www.getgoart.com (the “Website”), to you (the “Customer” or “you”). Please read these Terms carefully before placing an order. By placing an order, you agree to be bound by these Terms.


1. About Us

2. Our Products

2.1 GetGoArt offers art prints from original artwork (including those created by Alistair Morrison and other talented artists where indicated) and prints from digital artwork, which may also incorporate other mixed media elements. 2.2 All products are custom-printed on demand through our trusted fulfilment partner, Printful. 2.3 While we strive for accurate representation, the colours and appearance of products displayed on our Website may vary slightly from the actual product due to monitor settings, lighting conditions, and the printing process. 2.4 When you purchase a print from GetGoArt, you are purchasing a physical product. This purchase does not transfer any intellectual property rights in the artwork itself.


3. Ordering & Contract Formation

3.1 Placing an Order: To place an order, you select the desired products, add them to your shopping cart, and proceed to checkout. You will be guided through the process of providing shipping and billing information and selecting a payment method. 3.2 Order Acceptance: Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us. We will confirm our acceptance to you by sending you an email that confirms the product has been dispatched (“Dispatch Confirmation”). The contract between us (“Contract”) will only be formed when we send you the Dispatch Confirmation. 3.3 If We Cannot Accept Your Order: If we are unable to supply you with a product (e.g., due to stock unavailability or a technical error with Printful), we will inform you of this by email and will not process your order. If you have already paid for the product, we will refund you the full amount as soon as possible.


4. Price and Payment

4.1 The price of the products will be as quoted on our Website at the time you submit your order. Prices include VAT (where applicable) at the current UK rate, but may exclude delivery charges. Delivery charges may be added to your total order price during the checkout process and are clearly displayed where applicable. 4.2 We accept payment securely through the WooCommerce payment gateway integrated with Stripe, which allows for a wide range of payment methods including major credit and debit cards (e.g., Visa, Mastercard, American Express), and other digital payment options as supported by the Stripe facility. 4.3 Payment for all products and delivery charges is required in full at the time of order placement. 4.4 We use secure third-party payment processors. We do not store your full payment card details on our servers.


5. Shipping and Delivery

5.1 We partner with Printful for all printing and shipping. Printful uses various reputable shipping carriers (e.g., Royal Mail, FedEx, DHL, USPS) to deliver your order. 5.2 Delivery Timeframe: Once your order has been placed and payment is successfully received, please allow 6-10 business days for your item to be delivered. This timeframe includes production time and shipping transit. While we provide estimated delivery times, these are approximate and cannot be guaranteed, especially during peak seasons or due to unforeseen carrier delays beyond our control. 5.3 Incorrect Address: If an order is returned to Printful due to an incorrect or undeliverable address provided by the customer during checkout, you will be responsible for the cost of re-shipping the package. We will contact you to arrange payment for reshipment. 5.4 Unclaimed Shipments: If a package is unclaimed by the customer (e.g., not collected from a local depot) and is returned to Printful, you will be responsible for the cost of re-shipping the package. We will contact you to arrange payment for reshipment. 5.5 Risk of Loss: The risk of loss or damage to the products passes to you upon delivery of the products to the address you provided.


6. Returns & Refunds (Faulty Products & Lost Packages)

6.1 Your satisfaction with your GetGoArt purchase is important to us. As our products are custom-printed on demand, we handle returns and refunds specifically for items that are faulty or damaged upon arrival, or for lost packages. 6.2 All claims and inquiries regarding returns and refunds must be submitted directly to GetGoArt, not Printful. 6.3 Faulty or Damaged Items: * In the unfortunate event that your GetGoArt print arrives misprinted, damaged, or defective, we will gladly arrange a replacement or issue a full refund. * Claim Period: Claims for misprinted, damaged, or defective items must be submitted to us within 30 days of receiving your product. * How to Report: Please contact us immediately at [email protected]. * Required Information: To help us resolve the issue quickly, please include: your order number, a clear description of the fault or damage, and high-quality photographs of the faulty item and its packaging. * Resolution: Upon review and confirmation that the issue is due to a production error, we will either arrange for a replacement to be sent to you at no additional charge or process a full refund to your original payment method. We may ask you to return the faulty item, in which case we will provide a prepaid shipping label. 6.4 Lost Packages: If your GetGoArt order does not arrive, a claim for a lost package must be submitted to us within 30 days of the estimated delivery date. We will investigate the issue with our shipping partner. 6.5 Returns for “Buyer’s Remorse”: Due to the custom, print-on-demand nature of our products, we are unable to accept returns or offer refunds for “buyer’s remorse” (e.g., if you change your mind, or ordered the wrong size/artwork without a defect). We encourage you to carefully review product descriptions, sizing guides, and your order details before completing your purchase.


7. Your Legal Rights (Consumer Rights Act 2015)

7.1 We are under a legal duty to supply products that are in conformity with this Contract. As a consumer, you have statutory rights under the Consumer Rights Act 2015. For example, goods must be of satisfactory quality, fit for purpose, and as described. Nothing in these Terms will affect your statutory rights. 7.2 Your rights regarding faulty products are outlined in Section 6 above.


8. Cancellation Rights (Consumer Contracts Regulations 2013)

8.1 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you generally have a 14-day “cooling-off period” to cancel a distance contract. This period usually begins the day after you receive your goods. 8.2 Important Exception for Custom Goods: Please be aware that the right to cancel under these Regulations does not apply to goods that are made to your specifications or are clearly personalised. As all GetGoArt prints are produced on demand specifically for your order, they typically fall under this exemption. This means that once your order has been placed and production has begun, you generally do not have the right to cancel solely because you have changed your mind. 8.3 Any cancellation that is permitted (e.g., if the order has not yet entered production with Printful, or if it relates to a legal right not covered by the above exemption) must be requested by contacting us at [email protected].


9. Intellectual Property Rights

9.1 All intellectual property rights, including copyrights, trademarks, and design rights, in the artwork displayed on the Website and in the products sold, are owned by GetGoArt, Alistair Morrison, or other artists who have licensed their work to us. 9.2 Your purchase of any product does not grant you any rights to reproduce, distribute, publicly display, or otherwise exploit the artwork for commercial purposes. Products are for personal use only.


10. How We Use Your Personal Information

10.1 We will only use your personal information as set out in our Privacy Policy, which is available on our Website at [Link to your Privacy Policy page, e.g., www.getgoart.com/privacy-policy]. 10.2 Our Privacy Policy explains how we collect, use, store, and share your personal data, including data shared with our partners like Printful and payment processors.


11. Limitation of Liability

11.1 Nothing in these Terms limits or excludes our liability for: * death or personal injury caused by our negligence; * fraud or fraudulent misrepresentation; * breach of the terms implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982; * defective products under the Consumer Protection Act 1987; or * any matter for which it would be unlawful for us to exclude or attempt to exclude our liability. 11.2 Subject to clause 11.1, our total liability to you in respect of all losses arising under or in connection with the Contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the total price of the products purchased.


12. Events Outside Our Control (Force Majeure)

12.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control. 12.2 An Event Outside Our Control means any act or event beyond our reasonable control (e.g., strikes, lock-outs, or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport). 12.3 If an Event Outside Our Control takes place that affects the performance of our obligations under a Contract: * we will contact you as soon as reasonably possible to notify you; and * our obligations under a Contract will be suspended, and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of products to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.


13. Other Important Terms

13.1 Severability: Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect. 13.2 Waiver: If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of your breaking this Contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. 13.3 Third-Party Rights: This Contract is between you and us. No other person shall have any rights to enforce any of its terms. 13.4 Entire Agreement: These Terms and any document expressly referred to in them constitute the entire agreement between you and us and supersede and extinguish all previous agreements, promises, assurances, warranties, representations, and understandings between us, whether written or oral, relating to their subject matter. 13.5 Changes to these Terms: We may amend these Terms from time to time. Every time you order products from us, the Terms in force at that time will apply to the Contract between you and us. We will notify you of any significant changes by posting the updated Terms on our Website.


14. Governing Law and Jurisdiction

14.1 These Terms are governed by the laws of England and Wales. 14.2 You and we both agree that the courts of England and Wales will have exclusive jurisdiction over any dispute or claim arising out of or in connection with this Contract.
